Instant Win Game Period: The Rumson’s Rum Golden Nickel Instant Win Game (the “Instant Win Game”) begins at 12:00 a.m. Eastern Time (“ET”) on October 17, 2024 and ends at 11:59 p.m. ET on June 1, 2025 (the “Instant Win Game Period”).
Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 21 years of age and older as of date of participation. Employees of Pirate Dog Brand, LLC (the “Sponsor”), The Gold Group, Titanic: The Artifact Exhibition, their respective partners, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively “Released Parties”) and the immediate family members or persons living in the same household of each, are not eligible to participate or win. Void where prohibited or restricted by law.
How to Play. There is no purchase necessary to participate in the Instant Win Game:
1. To participate by purchasing a Product during the Instant Win Game Period: To participate by purchasing a product, look for a 750ml bottle of Rumson’s Gold Rum, Rumson’s Grand Reserve Rum, Rumson’s Spiced Rum or Rumson’s Coffee Rum (the “Product”), available at participating retailers, while supplies last. Remove the cap-seal of the Product to see if you reveal an official game message on the T-cork (“game message”). If your official game message includes the words “you won,” you are an instant winner of a Prize, subject to verification of eligibility. If you do not reveal any game message, you are not a winner of a Prize.
2. To participate without purchase of a Product during the Instant Win Game Period: To participate without purchasing a Product, on a plain 3”x5” paper, hand print your first and last name, full address, date of birth, phone number (including area code), and email address and mail your entry in an envelope with proper first class postage affixed to: Rumson’s Rum Golden Nickel Instant Win Game, 4 Florence Street – Unit 3, Salem, MA 01970 to have an opportunity to participate in the game for a Prize (the “Game Play”). All Game Plays must be handwritten and Game Plays must be postmarked by March 31, 2025 and received by April 7, 2025 to be eligible. Game Play requests will be played on participant’s behalf by Administrator. If it is determined by Administrator that you have won a Prize, you will be notified by mail/email by the Administrator. Only winning Game Play requests will be notified via mail/email. All Game Plays become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due Game Plays, which will be disqualified.
  
  The person submitting the Game Play or revealing a game message will be deemed the entrant (the “Entrant”). Participation is subject to disqualification of all Game Plays, if multiple accounts are used by the same person. All Game Plays/game message prize claims become property of the Sponsor.
To Claim a Prize: To claim a game message you received on Product, follow the instructions provided on the game message by visiting the website indicated by May 1, 2025. If you are determined a Prize winner via Game Play, you will be automatically receive the prize via the event website (as stated in Rule #7 below).
Instant Win Prize, Approximate Retail Value (“ARV”) and Approximate Odds of Winning: Prize (20 total): One pair of tickets to “Titanic: The Artifact Exhibition” (ARV: $79 pair).
Approximate odds of winning a Prize are 1 in 1,500. Limit one (1) Prize per person for the entire Instant Win Game Period. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.
Verification: All winners are subject to verification of eligibility. Game messages are subject to verification at the sole discretion of Sponsor/Administrator and include anti-fraud detection measures; if they are found to be photocopied, reproduced, altered, forged, defaced, tampered with, mutilated, stolen, unissued, unauthorized or illegible in any way or if they fail to contain special markings and/or security codes used by Sponsor in the Instant Win Game, they will be void. Game messages will also be void if defective or if they contain printing or other mechanical errors or are printed or produced in error. No prize will be awarded to the holder of a game message that is determined to be void or otherwise ineligible. All material submitted becomes the sole property of the Sponsor and will not be returned. Only specially marked Rumson’s Rum Golden Nickel game messages will be accepted and Game Pieces/game messages may not be combined with those from any other game/Instant Win Game. If, due to an error of any kind, more winning game messages are claimed as Prize winners, or more Prizes are claimed than are intended to be awarded according to Rule #5, the intended Prizes will be awarded in a random drawing from among all verified Prize claims received, as described above. In no event will the Sponsor be obligated to award more than the stated number of prizes.
General Rules: Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Potential Prize Winners will verify their wining code via the event website (www.TitanicBoston.us). By participating in the Instant Win Game, Entrants agree to be bound by these official rules and the decisions of the judges. Released Parties are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Instant Win Game or by any human error which may occur in the processing of the game messages or Game Plays in the Instant Win Game. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the instant win Game Play/game message process or the operation of the Instant Win Game; violates these official rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Instant Win Game if it is not capable of running as planned, including, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and award all Instant Win Prizes claimed from among all eligible Game Plays/game messages received prior to cancellation. Released Partes and each of their respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in the Instant Win Game or any prize awarded. Winners hold harmless the Released Parties for any injury or damage caused, or claimed to be caused, including death, by participation in the Instant Win Game or use or redemption of any prize. Acceptance of any prize constitutes permission to use winners’ names and likenesses for promotional purposes without further compensation except where prohibited by law. Sponsor is not responsible for any typographical or other error in the printing of the Instant Win Game materials or the offering or announcement of the prizes.
Dispute Resolution: By participating in this Instant Win Game, Entrants agree that to the extent permitted by applicable law: 1) Any and all disputes, claims, and of action arising out of or connected with the Instant Win Game or the prize shall be resolved individually, without resort to any form of class action; 2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and shall not include any punitive, consequential or other damages, including costs associated with participating in the Instant Win Game but in no event include attorneys’ fees; 3) The value of the prizes as set forth above represents Sponsor’s determinations of the ARV in its sole and absolute discretion thereof and such determinations are final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash; and 4) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All dispute resolution shall be made by the Sponsor in its sole discretion. These Official Rules shall be governed by, and construed in accordance with the laws of the state of Massachusetts without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Massachusetts. Any legal proceedings arising out of this Instant Win Game or relating to these Official Rules shall be instituted only in the federal or state courts located in the state of Massachusetts, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules.
